2. WHAT USE DO WE GIVE TO DIFFERENT TYPES OF COOKIES?

According to their purpose:

• Technical cookies: are those that allow the user to navigate through a website, platform or application and use the different options or services. For example, those used for session maintenance, response time management, performance or option validation, use of security elements and content sharing.

• Preference or customization cookies: These allow information to be remembered so that the user accesses the service with certain characteristics that can differentiate their experience from that of other users, such as language, number of results to display when the user performs a search, appearance or content of the service depending on the type of browser through which the user accesses the service or the region from which they access the service, etc.

• Analysis or measurement cookies (analytics): These allow the person responsible for them to monitor and analyze the behavior of users of the websites or Apps to which they are linked, including the quantification of ad impacts. The information collected through this type of cookies is used to measure the activity of websites, applications or platforms, in order to introduce improvements based on the analysis of usage data made by service users.

• Advertising/ad cookies: These are those which, processed by the App administrator or by third parties, allow us to analyze your Internet browsing habits so that we can show you advertising related to your browsing profile. Advertising cookies allow the management of advertising spaces based on specific criteria.

They are those that store information about user behavior obtained through continuous observation of their browsing habits, which allows the development of a specific profile to display advertising based on it.

Type of cookies according to the period of time they will remain active:

• Session cookies: These are designed to collect and store data while the user accesses a website/App. They are usually used to store information that is only of interest to keep for the provision of the service requested by the user on a single occasion (for example, a list of purchased products) and disappear when the session ends.

• Persistent cookies: These are those in which the data remains stored on the terminal and can be accessed and processed for a period defined by the cookie's controller, which can range from a few minutes to several years. In this regard, it must be specifically assessed whether the use of persistent cookies is necessary, since privacy risks could be reduced by using session cookies. In any case, when persistent cookies are installed, it is recommended to reduce their temporary duration to the minimum necessary according to the purpose of their use.

The legal obligations imposed by the regulations are two: the obligation of transparency and the obligation to obtain explicit consent from the website user.

According to the nature of their business activity, the business model they develop and the scope of their responsibility, it is recommended to carry out a review of the cookies being used, either internally or with the advice of specialized entities.

This review will aim to identify the cookies being used, analyzing whether they are own or third-party cookies, session or persistent, and specifying their function to decide whether they fall within the scope of application of article 22.2. Taking into account the possible changes that may occur in cookie management and use, it is recommended to periodically carry out this review in order to update the available information about these cookies. In any case, it should be noted that the solutions implemented to comply with the obligations of art. 22.2 of the LSSI must be technologically neutral and therefore must be solutions that most browsers recognize.
